STICKBULB TERMS & CONDITIONS:

Stickbulb LLC greatly values your business and looks forward to your enjoyment of the lamps you have purchased from us. All purchases and customer orders made from Stickbulb LLC constitute acceptance of the terms set forth herein.

NON-REFUNDABLE All Stickbulb LLC orders are non-refundable.

PRICES All prices are quoted in US dollars and are subject to change without notice.

QUOTES All quotes issued are valid for 30 days

LEAD TIMES begin with receipt of Purchase Order and deposit if applicable. Orders will ship when the invoice is paid in full. Lead times are as advertised for large quantity orders lead times may require 16-20 weeks.

CANCELLATIONS Cancellation of an order must be done within 5 days of confirmation of the order as no cancellations can be accepted following this 5-day period. Cancellations of a custom order must be made within 2 days of confirmation of the order. No cancellations are accepted on rush orders. Stickbulb LLC reserves the right to cancel any order after it has been placed.

PAYMENT TERMS: We accept payment by credit card, check, or wire transfer.

RUSH ORDER Orders may be rushed for a 20% fee and are approved on a case-by-case basis. All rush orders must be paid in full at the time of order placement. No cancellations can be accepted on rush orders.

REFUNDS Stickbulb LLC does not offer refunds Refunds are not issued except in the case of defective merchandise we are unable to replace.

RETURNS Because of the handmade nature of our designs, we are unable to accept returns. Defective merchandise will be accepted for company credit or exchange only if accompanied by an original receipt and in original condition and in original packaging. Returns must be pre-authorized by calling (347) 460 2852. Please be certain to return your purchase intact, in the original exterior box, well packed, insured for the full amount and sent at the customer’s expense to 10-40 46th Avenue, second flor. RESTOCKING FEE A restocking fee of 25% will be applied to all returned items. Refunds are not issued except in the case of defective merchandise we are unable to replace.

CREDITS are good for a period of one year following the date of issue. Thereafter, unused credit is forfeited. The actual cost of shipping the item to the customer will not be credited or refunded.

DAMAGED GOOD All designs are carefully tested. inspected and packaged prior to shipment. Please inspect your items immediately upon delivery as claims received after 7 days following delivery cannot be accepted.

CLAIMS All designs are carefully tested. inspected and packaged prior to shipment. Claims for defective or damaged items must be filed within 7 days of delivery. Customer shall notifyStickbulb LLC of any defect in the product or damage sustained during shipment within 7 days of receipt and shall retain all packaging. The customer shall take photographs of each side of the carton in which the products were shipped. including the shipping label, and provide such evidence of damages. If notice is not given within this 7-day timeframe. Stickbulb LLC reserves the right to reject any return of the products. If damage has occurred in shipping all packaging must be retained by the receiver. Failure to do so may invalidate any claim. There are no returns accepted on sale, clearance or discontinued products, or custom orders. These items are considered final sales and the customer is responsible for all shipping charges incurred.

CARE AND MAINTENANCE Instructions on how to care for and clean your Stickbulb LLC product will be packaged and shipped with your order. All products should be cared for with instructions applicable to that product Failure to do so may void the product warranty.

WARRANTY Stickbuld LLC warrants that Stickbulb LLC designs shall be free from defects in workmanship or materials under normal use and service for 1 year after the date of purchase. This warranty applies to designs purchased only by the original purchaser from an authorized reseller or distributor and excludes drivers who are covered by their manufacturer’s own warranties.  Stickbulb LLC makes no warranty with respect to or accepts any responsibility related to it. those components. Stickbulb LLC reserves the right to inspect the damaged product before having any obligation under this limited warranty. All costs of shipping for inspection shall be borne solely by the purchaser. All claims must be made by the purchaser within 5 days of the occurrence date. Stickbulb LLC, at its discretion, shall repair or replace the defective unit covered by this warranty.

LIMITATIONS OF WARRANTY In order to keep this limited warranty in effect, the product must have been handled and used as prescribed. Inis limited warranty does not cover any damage including, but not limited to, the following
improper installation, accident, misuse, abuse, or general negligence
Damage caused by improper cleaning or methods.
Damage caused by improper handling, installation, or assembly by the customer or customers agent
Damage caused by exposure to extreme moisture, humidity, or natural sunlight. Stickbulb lamps are designed to be installed in indoor, air-conditioned environments, out of prolonged direct sunlight.
Damage caused by Acts of God, fire, extreme weather, floods, tornadoes, hurricanes, war
Changes in the appearance of metal finishes or un-lacquered finishes
Any costs of installation. removal. or re-installation.
Restoration or repair work.
Any parts purchased separately from our light fixtures

LIABILITY In no event shall Stickbulb LLC be liable for any consequential indirect incidental special, exemplary, or punitive damages, lost profits or revenues, or diminution in value, arising out of or relating to any breach of these terms. whether or not the possibility of such damages has been disclosed in advance by the customer or could have been reasonably foreseen by the customer regardless of the legal or equitable theory (contract. tort or otherwise) upon which the claim is based. and notwithstanding the failure of any agreed or another remedy of its essential purpose.

LIABILITY In no event shall Stickbulb LLCs aggregate liability arising out of or related to this agreement, whether arising out of or related to breach of contract. tort (includina negligence) or otherwise. exceed the total of the amounts paid to Stickbulb LIC for the goods sold hereunder.

INDEMNIFICATION Customer will at all times defend, indemnify and hold harmless Stickbulb LLC and its officers, directors, shareholders, employees, accountants, attorneys, agents, affiliates, successors, and assigns from and against any and all damages, injuries including death, liabilities, costs, and expenses, including reasonable legal fees and expenses arising out of or related to third party claims, actions or demands arising out of or related to any 1) breach of any provision in these Terms by the customer or end-user or 2) improper or negligent installation or use, or unauthorized repair, or integration into another lighting product, of a Product by Customer or End User (or its agents). Customer shall not settle compromise or consent to the entry of any judgment with respect to any pending or threatened claim without Stickbulb _ Cs consent unless the settlement, compromise, or consent provides for and includes an express, unconditional release of all claims, damages, liabilities, costs, and expenses includina reasonable legal fees and expenses. against Stickbulb LLC.
